TERMS OF USE – THI LIMA | 3D, CONSULTING & ONLINE SCHOOL

1. INTRODUCTION AND ACCEPTANCE OF TERMS
 
1.1. Welcome to Thi Lima | 3D, Consulting & Online School. This website, its subdomains, courses, videos, educational materials, and other features (collectively referred to as the "Platform") are owned and operated by Thi Lima | 3D, Consulting & Online School, registered under CNPJ No. 28.075.630/0001-44.
 
1.2. By accessing, browsing, registering, or purchasing any course on the Platform, and by clicking “I Agree”, “Buy Now”, “Start Course”, or any other validation mechanism, you (hereinafter referred to as the "User") declare that you have read, understood, and expressly accepted these Terms of Use, as well as our Privacy Policy, binding yourself fully to them.
 
1.3. If you do not agree with any of the provisions set forth herein, you must not access or use the Platform, nor purchase any courses.
 
2. REGISTRATION, ACCOUNT SECURITY, AND ACCESS
 
2.1. To access and use the courses, the User must create an account by providing true, accurate, and updated information. The User is solely responsible for the veracity and accuracy of their registration data.
 
2.2. The processing of personal data collected on this Platform is strictly governed by applicable data protection laws, including the General Data Protection Regulation (GDPR) for European residents, the Brazilian General Data Protection Act (LGPD), and other local regulations, as detailed in our Privacy Policy.
 
2.3. The access credentials (login and password) are personal, exclusive, and non-transferable. Sharing account credentials with third parties under any pretext is strictly prohibited.
 
2.4. The User is solely responsible for maintaining the confidentiality of their account access details and for all activities that occur under their account. In case of suspected unauthorized use or breach of security, the User must immediately notify the Administration at: contato@thilima.com.br.
 
2.5. Monitoring System: The Platform utilizes security and monitoring tools to detect simultaneous logins, access from incompatible geographical locations, or anomalous traffic patterns. The detection of suspicious activity may result in the preventive or permanent suspension of the account, without the right to any refund, and without prejudice to applicable legal remedies.
 
3. COURSE LICENSE AND VIDEO PROTECTION
 
3.1. Upon purchasing an online course, the Platform grants the User a limited, revocable, non-exclusive, and non-transferable license to view the video lessons via streaming (online viewing) within the Platform's environment, for the duration specified on the purchased product page.
 
3.2. The granting of this license does not transfer, under any circumstances, the ownership of intellectual property or copyrights of the content to the User.
 
3.3. Video Security: The User is expressly prohibited from using screen capture software, unauthorized download tools, external recorders, or any other method to copy, extract, download, transmit, or save videos from the Platform. Any such action constitutes a direct violation of copyright laws.
 
3.4. The only materials authorized for download are those explicitly indicated and made available as downloadable resources on the Platform (such as exercise files, PDF guides, and code examples). Even these authorized downloaded materials may not be sold, distributed, or shared with third parties.
 
3.5. Drip Content / Gradual Release: The User acknowledges and agrees that access to the course content may be granted gradually and on a scheduled basis. For security purposes, pedagogical structure, and intellectual property protection, specific modules, bonuses, exercise files, or advanced lessons may only be unlocked after 7 (seven) calendar days from the purchase confirmation date. Information regarding which courses or modules are subject to gradual release will be available in the product description or the FAQ section of the courses' landing pages.
 
4. COPYRIGHT AND INTELLECTUAL PROPERTY
 
4.1. All content on the Platform—including, but not limited to, videos, texts, audio, images, software, source code, graphics, trademarks, logos, and visual identity—is protected by international copyright laws, treaties, and industrial property regulations. It remains the exclusive property of Thi Lima | 3D, Consulting & Online School or its licensors.
 
4.2. The User agrees not to reproduce, modify, publicly display, distribute, sell, rent, sublicense, or create derivative works from any material extracted from the Platform without prior, express written authorization from the owner.
 
4.3. Penalties and Consequences: Infringement of intellectual property rights constitutes a serious breach of contract and an illegal act under international copyright law (including the DMCA where applicable) and Brazilian law (Article 184 of the Criminal Code). The infringing User will face immediate termination of their account without any right to a refund. Furthermore, the User will be held liable for damages, lost profits, and contractual fines equivalent to up to 100 (one hundred) times the value of the purchased course, enforceable through legal action.
 
4.4. Third-Party Trademarks: Any third-party trademarks, product names, or logos displayed on the Platform (such as Autodesk, 3D Studio Max, etc.) are used solely for educational and descriptive purposes regarding the software, remaining the exclusive property of their respective owners.
 
5. CANCELLATION AND REFUND POLICY
 
5.1. 7-Day Money-Back Guarantee: The Platform offers a satisfaction guarantee. The User may request a full refund within 7 (seven) calendar days from the date of purchase confirmation or account activation, in compliance with applicable consumer protection regulations.
 
5.2. To request a refund within the 7-day period, the User must formalize the request exclusively by emailing contato@thilima.com.br or directly through the payment gateway used during checkout.
 
5.3. After the 7-day period has elapsed, no refunds or partial returns will be issued, given the immediate availability of the digital content and the nature of digital infoproduct licensing.
 
6. USER OBLIGATIONS AND PROHIBITED CONDUCT
 
6.1. The User agrees to use the Platform ethically and respectfully. It is strictly prohibited to:
 

  • Share or grant access to their account to third parties;

  • Use bots, spiders, web scraping, or data mining techniques to extract content automatically from the Platform;

  • Post any content in the comments, community areas, or forums that is offensive, defamatory, libelous, discriminatory, racist, pornographic, or illegal;

  • Engage in spamming or post unauthorized advertisements and promotional links;

  • Attempt to bypass, disable, or corrupt the Platform's security and encryption mechanisms.


6.2. Any breach of these obligations will result in temporary suspension or permanent termination of the User's access, at the sole discretion of the administration, without prejudice to legal action for damages.

 7. GENERAL PROVISIONS AND AMENDMENTS
 
7.1. Thi Lima | 3D, Consulting & Online School reserves the right to modify these Terms of Use or the Platform itself at any time due to legal, technical, or operational updates. Users will be notified of material changes via email or a prominent notice on the Platform. Continued use of the Platform after such notification constitutes acceptance of the updated terms.
 
7.2. If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
 
7.3. Governing Law and Jurisdiction: These Terms of Use shall be governed by and construed in accordance with the laws of Brazil. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the Courts of São Paulo / SP, Brazil, to which the User expressly submits.
